Terms and Conditions of Use

These Terms and Conditions govern access to and use of LUKSUS, including its websites, PWA, panels, APIs, profiles, chats, premium feed, vault, gifts, Diamonds, payments, transfers, verifications, and related services.

By creating an account, browsing, publishing content, buying Diamonds, sending gifts, unlocking content, using chat, registering an agency, requesting a payout, or accepting an invitation, the user states that they have read, understood, and accepted these terms, the Privacy Policy, community rules, payment policies, and any applicable annex.

Users may register or log in using email, Google, Facebook, or other identity providers enabled by LUKSUS. By using an external provider, the user authorizes the exchange of the information necessary to authenticate the account and accepts that such provider may apply its own terms, privacy policies, security rules, and availability conditions.

If the user acts on behalf of a company, agency, brand, representative, model, or third party, the user states that they have sufficient authority to bind that party. If the user does not accept these terms, they must refrain from using LUKSUS.

LUKSUS is an adult technology platform that enables discovery, premium content, private communications, digital gifts, wallet, payments, transfers, professional profiles, agency tools, and a directory of companionship experiences permitted by applicable law.

LUKSUS is not an employer, representative, agent, pimp, producer of third-party content, guarantor of in-person encounters, sexual services broker, financial institution, exchange house, insurer, or fiduciary. When in-person experiences are enabled, LUKSUS acts as a technological directory or channel, unless a written contract expressly states otherwise.

Any in-person agreement permitted by law is entered into directly between the people involved. LUKSUS does not compel, require, coordinate, or charge for sexual acts, exploitation, trafficking, coercion, illegal services, or activities that violate human rights.

To protect the platform, users, and LUKSUS, any illegal, abusive, deceptive, risky, or non-compliant conduct is prohibited.

All published or sent content must involve only consenting adults with legal capacity, identifiable for verification purposes where applicable, and must have been created, published, and distributed with valid consent.

LUKSUS may review, classify, hide, demonetize, block, remove, or preserve content when there is a report, suspicion of breach, legal risk, intellectual property infringement, harm to third parties, an authority request, or a need to protect the platform.

LUKSUS, its brand, software, interfaces, design, code, databases, flows, texts, logos, iconography, Diamonds system, compilations, dashboards, and documentation are the property of LUKSUS or its licensors.

Each creator retains rights over their content, except where expressly assigned. By publishing on LUKSUS, the creator grants the platform a worldwide, non-exclusive license, sublicensable to providers, hostable, reproducible, communicable, technically adaptable, and exploitable only to operate, display, promote, monetize, moderate, protect, and improve LUKSUS.

Diamonds are internal platform credits used to access digital features, gifts, content, chats, or enabled experiences. They are not money, not a bank deposit, do not bear interest, are not a financial instrument, are not a tradable security, and have no resale value for clients.

Prices, commissions, taxes, fees, packages, conversions, payment method availability, and consumption rules may change. Before confirming a transaction, the user must review the total price, digital product description, number of Diamonds, currency, taxes, and applicable conditions.

Models, creators, and agencies may receive net payouts according to their role, applicable commission, payout rules, verification, taxes, withholdings, reserves, adjustments, chargebacks, sanctions, blocks, and provider availability.

LUKSUS may reasonably suspend or hold payments where there is fraud investigation, exploitation, impersonation, dispute, contractual breach, consumer claim, authority request, chargeback risk, or need to protect victims.

Refunds are evaluated according to product or service type, consumption status, technical evidence, fraud, attributable error, consumer protection law, gateway policies, and these terms.

Abuse of reversals, denials, chargebacks, or false claims causes suspension, loss of access, payment method blocking, balance offsets, processor reports, and legal action.

When LUKSUS displays companionship profiles, independent escort profiles, or legally permitted in-person experiences, the platform operates as a technological directory. The user understands that any physical meeting involves personal, legal, and financial risks that must be assessed directly by the parties.

LUKSUS does not guarantee availability, conduct, suitability, punctuality, safety, compatibility, outcome, local legality, or performance of in-person agreements between independent users.

The Privacy Policy forms part of these terms. By using LUKSUS, the user authorizes the processing of personal data according to that policy.

When a user accesses through Google, Facebook, or another external provider, LUKSUS will use the received data only to create, authenticate, protect, and manage the account, without implying that those providers are responsible for the content, payments, interactions, or services of LUKSUS.

Users must respect the confidentiality of identities, chats, content, location, contact information, private agreements, and any intimate information obtained within LUKSUS. Public exposure, doxing, blackmail, or content leaks will result in expulsion and legal action.

LUKSUS may warn, limit, hide, demonetize, suspend, block, terminate accounts, restrict payments, remove content, cancel transactions, or deny access when there is actual or suspected breach of these terms, risk to users, fraud, abuse, legal request, reputational harm, or operational need.

Termination of an account does not eliminate pending obligations, debts, investigations, licenses granted for evidence, confidentiality duties, indemnities, liability limitations, or rights acquired by LUKSUS or third parties.

LUKSUS is provided as is and as available. To the maximum extent permitted by law, we do not guarantee continuous availability, absence of errors, compatibility with all devices, economic results, successful encounters, income, audience growth, model responses, or subjective satisfaction.

Nothing in these terms excludes non-waivable statutory consumer guarantees where applicable. In case of conflict between these terms and a mandatory consumer protection rule, the mandatory rule prevails.

To the maximum extent permitted by law, LUKSUS will not be liable for indirect damages, lost profits, loss of opportunity, reputational harm, loss of data caused by third parties, user conduct, in-person encounters, off-platform agreements, content uploaded by third parties, or failures of gateways, banks, networks, hosting, or external providers.

The user agrees to indemnify, defend, and hold harmless LUKSUS, its administrators, employees, contractors, providers, and affiliates against claims, penalties, losses, costs, damages, and fees arising from their content, conduct, fraud, breach of these terms, infringement of rights, privacy violations, tax or labor obligations, or illegal activities.

These terms are interpreted under the laws of the Republic of Colombia, without prejudice to mandatory rules on consumer protection, personal data, e-commerce, or jurisdiction that may apply due to the user residence.

Before starting a dispute, the parties will attempt to resolve it directly through support or notice to legal@luksus.app. If no solution is reached, disputes may be submitted to the competent jurisdiction in Bogota D.C. or another valid alternative mechanism agreed in writing by the parties, without limiting the non-waivable rights of consumers or data subjects.
